Last Updated: 06/01/2026 These Terms of Service ("Terms") govern your access to and use of the Aureum platform ("Service") operated by Aureum AI, LLC ("Aureum," "we," "our," or "us"). By accessing or using the Service, you agree to these Terms. Your use of the Service is also subject to Aureum's Acceptable Use Policy, which is incorporated into these Terms by reference. By using the Service, you agree to comply with the Acceptable Use Policy. If you do not agree, you may not use the Service.
Aureum provides software tools that assist real estate professionals in monitoring communication, detecting silence, and supporting follow-up related to active real estate transactions and client relationships. Aureum does not provide brokerage services, legal advice, or business guarantees.
By using Aureum, you agree that: • You will use the Service only for lawful business purposes. • You are solely responsible for obtaining and maintaining any required client consent for communications. • You will not use the Service for spam, mass marketing, or unsolicited messaging. • You will not attempt to bypass system controls, safeguards, or compliance restrictions. • You are responsible for how you communicate with your own clients. • You remain fully responsible for your professional conduct and compliance with applicable laws and regulations.
Aureum supports one-to-one relationship-based messaging related to real estate business activities. Promotional or bulk marketing use is not permitted unless explicitly authorized by Aureum. Message frequency varies. Message and data rates may apply. Recipients may opt out at any time by replying "STOP" and may request assistance by replying "HELP." Use of messaging features is subject to Aureum's Acceptable Use Policy. Messaging functionality may be restricted, suspended, or terminated for users who violate the Acceptable Use Policy or create regulatory or carrier compliance risk. Opt-out requests are enforced automatically and permanently at the phone-number level, and users may not override or circumvent opt-out controls. Failure to comply with messaging rules may result in suspension or termination of service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Aureum promptly of any unauthorized use or security breach.
If the Service includes paid subscription plans: • Subscriptions are billed on a recurring basis according to the plan selected. • By providing payment information, you authorize Aureum to charge your payment method for all applicable fees. • If a free trial is offered, your subscription will automatically convert to a paid plan unless canceled before the trial ends. • Fees are non-refundable except as expressly stated in the Refund & Cancellation Policy. • Billing terms, cancellation rules, and refund limitations are governed by the Refund & Cancellation Policy, which is incorporated into these Terms by reference. • Aureum may change pricing with reasonable advance notice.
Aureum may operate in beta or early-access phases. Features, behavior, and availability may change at any time. While we strive to maintain reliable service, we do not guarantee uninterrupted or error-free operation. Temporary outages may occur due to maintenance, upgrades, or third-party service dependencies. You acknowledge that data loss, delays, or interruptions may occur, and you agree to use the Service at your own risk.
Submitting an early access request, scheduling an Early Access Consultation, or participating in an early access review does not guarantee access to Aureum. Aureum may approve, deny, pause, or revoke early access at its discretion. Access credentials or access codes are issued only after review and approval. Early access features, availability, onboarding requirements, and pricing may change as the platform develops. Approved users may be required to complete additional onboarding, confidentiality, or verification steps before access is issued. Users may not share access codes, login credentials, or account access with unauthorized individuals.
Use of the Service is subject to our Privacy Policy, which explains how we collect, use, and retain information. By using Aureum, you consent to the data practices described there.
You may not: • Use Aureum to send illegal, deceptive, abusive, unsolicited, or harmful communications • Engage in bulk messaging, list blasting, or spam • Attempt to bypass rate limits, opt-out controls, or other safeguards • Use the platform in violation of carrier, messaging, or telecommunications regulations • Attempt to reverse engineer, disrupt, or interfere with system operation Aureum may suspend, restrict, or terminate accounts that violate these Terms, the Acceptable Use Policy, or create regulatory or carrier risk.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Aureum is not liable for: • Lost revenue, lost business, or missed opportunities • Failure to close transactions • Indirect, incidental, or consequential damages Aureum does not guarantee any business outcomes, client responses, or deal results.
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
If Aureum offers a free trial, the following terms apply: Aureum may provide a limited-time free trial to allow users to evaluate the Service. The duration and availability of the trial are determined by Aureum and may be modified or discontinued at any time. Free trials are limited to one per user. Eligibility is determined based on factors including, but not limited to, phone number and payment method. Users may not create multiple accounts or use alternate information to obtain additional trials. During the free trial period, certain features of the Service may be restricted or unavailable. Access to full functionality, including messaging capabilities, may require a paid subscription. If you do not cancel before the end of the trial period, your account may automatically transition to a paid subscription in accordance with your selected plan. Aureum reserves the right to modify, limit, or terminate free trial access at any time if abuse, misuse, or suspicious activity is detected.
Aureum processes customer data in accordance with its Data Processing Addendum ("DPA"), which is incorporated into these Terms by reference. By using the Service, you acknowledge and agree that: • You act as the data controller with respect to any personal data you submit to the Service • Aureum acts as a data processor on your behalf • You are responsible for ensuring that your collection and use of personal data complies with applicable laws The DPA outlines how Aureum handles, processes, and protects customer data and forms part of this Agreement.
Aureum may provide AI-generated insights, recommendations, or suggested communications to assist users. These outputs are generated automatically and may not always be accurate, complete, or appropriate. Aureum does not guarantee the accuracy or effectiveness of any AI-generated content. Users are solely responsible for reviewing, editing, and approving all actions taken based on AI-generated suggestions. Aureum is not liable for any outcomes, decisions, or actions taken based on AI-generated outputs.
Your use of the Service is also governed by the following policies, which are incorporated into these Terms by reference: • Privacy Policy • Acceptable Use Policy • Data Processing Addendum • AI Usage Policy • SMS Messaging Policy • Refund & Cancellation Policy These policies form part of this Agreement and should be reviewed carefully.
