Terms of Service — Aureum AI, LLC

Last Updated: 02/05/2026 These Terms of Service ("Terms") govern your access to and use of the Aureum platform ("Service") operated by Aureum AI, LLC ("Aureum," "we," "our," or "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Service Description

Aureum provides software tools that assist real estate professionals in monitoring communication, detecting silence, and supporting follow-up related to active real estate transactions and client relationships. Aureum does not provide brokerage services, legal advice, or business guarantees.

2. User Responsibilities

By using Aureum, you agree that: • You will use the Service only for lawful business purposes. • You are solely responsible for obtaining and maintaining any required client consent for communications. • You will not use the Service for spam, mass marketing, or unsolicited messaging. • You will not attempt to bypass system controls, safeguards, or compliance restrictions. • You are responsible for how you communicate with your own clients. • You remain fully responsible for your professional conduct and compliance with applicable laws and regulations.

3. Messaging Use and Compliance

Aureum supports one-to-one transactional and relationship-based messaging related to real estate business activities. Promotional or bulk marketing use is not permitted unless explicitly authorized by Aureum. Message frequency varies. Message and data rates may apply. Recipients may opt out at any time by replying "STOP" and may request assistance by replying "HELP." Use of messaging features is subject to the Messaging Compliance Agreement (SMS Acceptable Use Policy), which must be accepted before messaging is enabled. That agreement is incorporated into these Terms by reference. Opt-out requests are enforced automatically and permanently at the phone-number level, and users may not override or circumvent opt-out controls. Failure to comply with messaging rules may result in suspension or termination of service.

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Aureum promptly of any unauthorized use or security breach.

5. Subscription, Billing, and Payments

If the Service includes paid subscription plans: • Subscriptions are billed on a recurring basis according to the plan selected. • By providing payment information, you authorize Aureum to charge your payment method for all applicable fees. • If a free trial is offered, your subscription will automatically convert to a paid plan unless canceled before the trial ends. • Fees are non-refundable except as expressly stated in the Refund & Cancellation Policy. • Billing terms, cancellation rules, and refund limitations are governed by the Refund & Cancellation Policy, which is incorporated into these Terms by reference. • Aureum may change pricing with reasonable advance notice.

6. Beta and Service Availability

Aureum may operate in beta or early-access phases. Features, behavior, and availability may change at any time. While we strive to maintain reliable service, we do not guarantee uninterrupted or error-free operation. Temporary outages may occur due to maintenance, upgrades, or third-party service dependencies. You acknowledge that data loss, delays, or interruptions may occur, and you agree to use the Service at your own risk.

7. Data and Privacy

Use of the Service is subject to our Privacy Policy, which explains how we collect, use, and retain information. By using Aureum, you consent to the data practices described there.

8. Prohibited Use

You may not: • Use Aureum to send illegal, deceptive, abusive, or harmful messages • Attempt to reverse engineer, disrupt, or interfere with system operation • Use the platform in violation of carrier, messaging, or telecommunications regulations Aureum may suspend or terminate accounts that violate these rules or pose compliance risk.

9. Limitation of Liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Aureum is not liable for: • Lost revenue, lost business, or missed opportunities • Failure to close transactions • Indirect, incidental, or consequential damages Aureum does not guarantee any business outcomes, client responses, or deal results.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
